Wheeling, IL — April 20, 2007 — e360Insight announced today it has uncovered a for-profit alter ego used to collect payment from U.S. companies for using the Spamhaus blacklist. After issuing subpoena's to seventeen of Spamhaus U.S.-based customers, e360 obtained copies of invoices issued by Spamhaus Technology LTD and The Spamhaus Project LTD, proving Spamhaus does conduct business in the United States.
On September 15, a U.S. Federal Judge ordered Spamhaus.org to pay $11.7 million in compensatory damages and issued a permanent injunction against Spamhaus’ email blocking technology. The permanent injunction explicitly prohibits Spamhaus from interrupting e360’s email messages in any way without providing supporting evidence. The order also requires Spamhaus to post a message on its website indicating e360 was incorrectly listed on the Spamhaus blacklist. Spamhaus is not currently listing e360 on its blacklist, but they have failed to post the correction as required by the court order.
In a response to a citation to discover assets issued by e360 to Spamhaus, Mr. Steve Linford, Spamhaus' founder, filed a sworn affidavit with the court stating, "Spamhaus has no subsidiaries, successors, or other related entities..." The invoices obtained by e360 during its investigation prove that Mr. Linford made false statements to the court.
"Ask any of the thousands of U.S. companies that have been victimized by Spamhaus and they will tell you a long story about how Spamhaus has improperly destroyed their legitimate business," said David Linhardt, e360's President & CEO. "If that's not enough to make the case, then simply go to Juno.com's or RoadRunner's website where they clearly state they use Spamhaus to block email messages to their subscribers. The fact is everyone in the industry knows Spamhaus does business in the United States. Mr. Linford's claim that he doesn't do business in the U.S. is simply ridiculous. Mr. Linford is trying to pull a fast one on the court. Fortunately for legitimate marketers, we've got him."
E360's position is that Spamhaus.org is a fanatical, vigilante organization operating in the United States with blatant disregard for U.S. law. In addition, E360 has proven Spamhaus routinely exposes their customers and volunteers to extreme legal risk by continuing to engage in improper blacklisting, defamation, extortion and blackmail in the name of fighting spam.
“Our next steps are to continue identifying Spamhaus assets and continue enforcing the court’s judgment in the U.S. and in the U.K. if necessary,” says Linhardt. “I suspect Spamhaus is going to find it to be very difficult to continue operating as a going concern."
