  Spamhaus Thumbs Its Nose At U.S. Federal Court  
Vigilante Group Spamhaus Believes It Is Untouchable
  Wheeling, IL —September 20 , 2006—Today, Spamhaus violated a U.S. Federal Court order to remove e360Insight from its blacklist. On September 13, a U.S. District Court in Illinois issued a permanent injunction against Spamhaus prohibiting them from taking any action that would cause e360’s email messages “to be blocked, delayed, altered, or interrupted in any way.” In addition, the court also ordered Spamhaus post a correction on www.spamhaus.org stating e360 was “erroneously listed” on the Spamhaus’ email blacklist. So far, Spamhaus has refused to comply with the court order. Spamhaus has not removed e360 from its blacklist and they have not posted the correction message on their website as ordered by the court.

Steve Linford, the Chief Executive of Spamhaus, has made several public statements on his website and in Google message boards. “Judge Kocoras is in his 70s and probably signed whatever was put in front of him,” says Linford.

Linford continues to claim that Spamhaus does not operate or conduct business in the U.S. However, this claim seems to contradict several facts about Spamhaus that are well known in the industry. Firstly, Spamhaus sells and markets its blocking technology to U.S. companies and clearly posts its rates on its website in U.S. dollars. For example, according to their website, Spamhaus charges $14,400 per year in annual fees for an unlimited license to use their email blocking technology. Secondly, Spamhaus uses servers in San Franciso provided by SuperNews, Inc. to provide DNS services for its website. Thirdly, Spamhaus uses PayPal, a U.S-based payment processor, to collect fees from its customers in the U.S. Finally, Spamhaus uses a domain, spamhaus.org, which is governed by the laws of the United States.

“Linford’s claim that Spamhaus doesn’t do business in the U.S is completely false and without merit” says David Linhardt, President of e360. “The fact of the matter is that Spamhaus uses their improper blocking technology to interrupt millions of dollars of legitimate commerce in the U.S. every day. Ask Internet Service Providers in the U.S. and 65% of them will tell you they use Spamhaus’ technology to block email.”

E360's position is that Spamhaus.org is a fanatical, vigilante organization operating in the United States with blatant disregard for U.S. law. In addition, E360 has proven Spamhaus routinely exposes their customers and volunteers to extreme legal risk by continuing to engage in improper blacklisting, defamation, extortion and blackmail in the name of fighting spam.

“Our next step is to seek enforcement of the court’s judgment in the U.S. and in the U.K. if necessary,” says Linhardt. “I suspect Spamhaus is going to find it to be very difficult to continue doing business in the U.S. in the near future.”
