Wheeling, IL —October 31, 2006—U.S. Federal Judge denied all of Spamhaus' motions today in open court. In addition, Judge Kocoras ordered Spamhaus to comply with e360's motion for a citation to show assets. Spamhaus must present its assets to the court in order to satisfy its financial obligation to pay e360 $11.7 million in damages for improper blacklisting.
Upon hearing arguments made by Matthew M. Neumeier, lead counsel from Jenner & Block representing Spamhaus, Judge Kocoras emphatically stated, "That argument is not going to carry the day."
"Today's ruling is a victory for all Americans who value their personal freedom and the right to control their inbox," said David Linhardt, President & CEO of e360. "Identifying assets is the first step toward enforcing the judgement against Spamhaus. We are hopeful Spamhaus will finally be held accountable for their improper, vigilante tactics which prevent Americans from deciding which email messages they receive. Spamhaus may have more difficulty interfering with U.S. companies who are operating according to U.S. law."
What's At Stake For All Americans
The U.S. Government used taxpayer dollars to create, develop and commercialize the Internet. Now, a foreign organization is using the Internet to interfere with the personal freedoms of all Americans.
Spamhaus, a UK-based organization with servers in San Francisco, is currently defying a U.S. Federal Court order and is improperly blocking email messages affecting millions of Americans everyday. Thousands of Internet Service Providers and system administrators are using Spamhaus right now to block email messages. As a result, Americans are unable to receive the messages they have requested.
Spamhaus v. e360Insight, is currently under appeal in U.S. Federal Court.
e360 encourages all Americans to contact their representatives and encourage them to support enforcement of the federal court order.
