08.23.06 - Judge Charles P. Kocoras grants e360 its motion for entry of default against Spamhaus. The Judge also covers the lower Court's Temporary Restraining Order into a permanent injunction.



August 30, 2006 - Synergy Law Group files a motion for Default Judgment and Order for Permanent Injunction







09.12.06 - Judge Charles P. Kocoras conducts a hearing and takes Synergy Law Group's motion under consideration. .

09.13.06 - Judge Charles P. Kocoras grants e360's motion for default judgment and issues a permanent injunction. Judge orders Spamhaus to pay $11,715,000 in compensatory damages to e360Insight. Judge issues permanent injunction against Spamhaus prohibiting them from listing e360Insight without clear and convincing evidence.



After receiving the judgment, Spamhaus refused to comply with the court's order. The truth is Spamhaus uses servers in the U.S., lists U.S. companies on its blacklist, interrupts legitimate commerce in the U.S., uses servers in the U.S., markets and sells services to U.S. companies, charges for its services in U.S. dollars according to rates published on its website, has collected money from U.S. companies, uses a U.S. payment processor to collect these payments and uses a domain subject to U.S. law. Importantly, Spamhaus did not contest jurisdiction when appearing in U.S. court. In spite of these facts, Mr. Linford has made public statements claiming Spamhaus is not subject to U.S. law.











10.19.06 - The court denied e360's motion to suspend spamhaus.org in order to force Spamhaus to comply with the courts judgment and the permanent injunction. e360 made this motion in an effort to help enforce the court's ruling in this matter.













November 2006 through February 2007, e360 and Spamhaus engage in a series of mediation discussions. e360 proposes several options for settling the matter. Spamhaus fails to propose an option for settling the matter. Spamhaus creates new listings for bargaindepot.net, a domain known by Spamhaus to be owned by e360. As a result of Spamhaus' refusal to remove the listings, e360 declines to participate in further mediation. e360 resumes its efforts to collect on the judgment.
